Rental Agreement
This Rental Agreement ("Agreement") is made between East Coast Expeditions LLC ("Owner") and the undersigned renter(s) ("Renter"). By completing a booking, Renter acknowledges having read, understood, and agreed to the following terms and conditions.
1. Definitions
- Owner: East Coast Expeditions LLC, provider of the rental vehicle and equipment.
- Renter: The individual named in the booking who assumes all responsibilities under this Agreement.
- Vehicle: The rental truck, including rooftop camper, keys, accessories, and camping equipment supplied by Owner.
- Rental Period: Begins when possession of the Vehicle is transferred to Renter and ends when the Vehicle is returned to Owner.
- Permitted Driver: Renter and any additional drivers expressly approved in writing by Owner.
2. Driver Eligibility
- All drivers must be at least 21 years old and hold a valid driver's license.
- Only Permitted Drivers may operate the Vehicle.
- Renter assumes full responsibility for actions, damages, or liabilities caused by any driver.
3. Vehicle Use
- Vehicle must only be operated on paved or maintained gravel roads.
- Prohibited: off-road driving, rock crawling, water crossings, or use on unmaintained trails.
- Vehicle may not be used for carrying passengers or property for hire; racing, testing, or competitions; towing/pushing other vehicles unless approved; driving under the influence of alcohol, drugs, or impairing medication; or transportation of contraband or unlawful activity.
- All passengers must wear seatbelts while in motion.
4. Camping Equipment & Rooftop Camper
- The rental includes rooftop camper, bedding, cooking gear, and accessories.
- Equipment must be returned clean and in the same condition.
- Renter is liable for repair or replacement of lost, stolen, or damaged equipment.
5. Prohibited Uses
The following actions are violations of this Agreement:
- Allowing anyone other than a Permitted Driver to operate the Vehicle.
- Carrying more passengers than available seatbelts.
- Off-road driving, water fording, dune driving, or trail use.
- Bringing pets without written approval.
- Using the awning without Owner's permission.
- Climbing onto the roof of the Vehicle (other than proper rooftop tent use).
- Leaving the Vehicle unlocked or unsecured.
- Taking the Vehicle to unauthorized locations (e.g., Mexico, festivals such as Burning Man).
- Smoking or vaping inside the Vehicle or camper.
Violation may void insurance coverage and make Renter fully liable for damages.
6. Insurance & Liability
- Renter is responsible for all damage to the Vehicle up to the deductible.
- If Renter breaches this Agreement, insurance is void and Renter is liable for the full cost of repairs, losses, diminished value, towing, impound, storage, and loss-of-use charges.
- Owner is not responsible for personal property left in the Vehicle.
7. Accident Reporting
- Renter must notify Owner immediately of any accident, theft, vandalism, or breakdown.
- Accidents with injury, theft, vandalism, or third-party damage must be reported to police and a police report obtained.
- A written incident report and photos must be provided to Owner within 24 hours.
- Failure to report may result in denial of coverage and full liability.
8. Maintenance & Repairs
- Renter may not authorize repairs without Owner's consent, except for safety.
- Routine issues (tires, windshield chips, bulbs) are Renter's responsibility.
- Roadside assistance depends on insurance package.
9. Tolls, Tickets, and Violations
- Renter is responsible for all tolls, tickets, fines, towing, storage, and impound fees during the Rental Period.
- If Owner processes violations, a $50 administrative fee per occurrence applies.
10. Return Policy
- Vehicle must be returned at the agreed time and location.
- Late returns incur daily rental charges plus a $100 fee.
- Vehicle must be returned with a full tank of correct fuel (mis-fueling is Renter's liability), clean inside and out, and with all equipment intact.
- Cleaning fees apply for excessive dirt, odors, or pet hair.
- Owner reserves the right to repossess the Vehicle if terms are breached.
11. Security Deposit & Payment Authorization
- A refundable deposit is required.
- Deposit may be used for damages, cleaning, late fees, lost gear, or violations.
- If costs exceed the deposit, Renter will be billed.
- Renter authorizes Owner to charge the card on file for any amounts owed (damages, lost equipment, fuel shortages, tolls, tickets, cleaning fees, late return charges).
12. Pets Policy
- Pets require prior written approval and may incur additional fees.
- Service animals are permitted by law.
13. Indemnification
- Renter agrees to indemnify and hold harmless Owner, employees, and agents from any claims, damages, or expenses arising from use of the Vehicle.
- This includes third-party claims, injuries, property damage, towing, attorney's fees, and legal costs.
14. Cancellation & Refund Policy
- Cancellations 14+ days before rental: full refund.
- 7–13 days before rental: 50% refund.
- Less than 7 days: non-refundable.
- Owner may cancel for safety or unforeseen events (full refund to Renter).
- Force majeure (natural disasters, government restrictions, etc.) releases Owner of liability.
15. Condition & Inspection
- Pre-rental inspection with photos/video will be signed by both parties.
- Post-rental inspection will be completed at return.
- Renter is responsible for damage, missing items, or excessive wear not noted at pickup.
- An inventory list of included gear will be reviewed and signed.
16. Governing Law
- This Agreement is governed by New Hampshire law.
- Venue is exclusive to Rockingham County courts.
- Renter waives the right to a jury trial to the extent permitted by law.
Acknowledgment: By completing a booking, Renter acknowledges they have read and understood this Agreement, accept responsibility for the Vehicle and equipment, and agree to comply with all terms.
